Contributor License Agreement (CLA)¶
Thank you for your interest in contributing to AeroStream and the AeroStream Client SDKs!
In order to clarify the intellectual property license granted with Contributions from any person or entity, Gradient Geeks ("Project Maintainers") requires that a Contributor License Agreement ("CLA") be accepted by each contributor before their Contributions can be incorporated into the project.
This agreement protects you, the project maintainers, and the AeroStream community. It ensures that AeroStream remains legally unencumbered and that users can depend on it in production environments.
Terms and Conditions¶
1. Definitions¶
- "You" (or "Contributor") means the individual or legal entity entering into this Agreement. For legal entities, the entity making a Contribution and all entities that control, are controlled by, or are under common control with that entity are considered to be a single Contributor.
- "Contribution" means any original work of authorship, including any modifications or additions to an existing work, that is intentionally submitted by You to Gradient Geeks for inclusion in, or documentation of, any of the products owned or managed by Gradient Geeks (the "Project").
- "Submit" means any form of electronic, verbal, or written communication sent to Gradient Geeks, including but not limited to communication on electronic mailing lists, source code control systems (such as GitHub pull requests or issues), and issue tracking systems.
2. Grant of Copyright License¶
Subject to the terms and conditions of this Agreement, You hereby grant to Gradient Geeks and to recipients of software distributed by Gradient Geeks a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to:
- Reproduce, prepare derivative works of, publicly display, publicly perform, sublicense, and distribute Your Contributions and such derivative works; and
- License, sublicense, and distribute Your Contributions under the Apache License 2.0 or any other open-source, source-available (including BSL/FSL), or commercial license that Gradient Geeks may choose for future versions of the Project.
3. Grant of Patent License¶
Subject to the terms and conditions of this Agreement, You hereby grant to Gradient Geeks and to recipients of software distributed by Gradient Geeks a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable (except as stated in this section) patent license to make, have made, use, offer to sell, sell, import, and otherwise transfer the Work, where such license applies only to those patent claims licensable by You that are necessarily infringed by Your Contribution(s) alone or by combination of Your Contribution(s) with the Work to which such Contribution(s) was submitted.
If any entity institutes patent litigation against You or any other entity (including a cross-claim or counterclaim in a lawsuit) alleging that your Contribution, or the Work to which you have contributed, constitutes direct or contributory patent infringement, then any patent licenses granted to that entity under this Agreement for that Contribution or Work shall terminate as of the date such litigation is filed.
4. Right to Re-License¶
You understand and agree that Gradient Geeks reserves the right to re-license, dual-license, or change the licensing terms of the Project (including future versions and distributions containing Your Contribution) under alternative licensing structures without requiring individual re-authorization, while preserving the public availability of previously released versions.
5. Representation of Originality¶
You represent that:
- Each of Your Contributions is entirely Your original creation; or
- You have sufficient rights to submit the Contribution under these terms, and Your submission does not violate any third-party rights, patents, copyrights, trademarks, or non-disclosure agreements.
- If Your employer has intellectual property rights over work you create, You have received permission to make Contributions on behalf of that employer, or Your employer has waived such rights for Your Contributions to AeroStream.
6. Disclaimer of Warranty¶
Except for the representations stated in Section 5, You provide Your Contributions on an "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including, without limitation, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE.
How to Accept¶
When you open a Pull Request against any public repository under the gradientgeeks organization (such as github.com/gradientgeeks/aerostream-sdk), our automated CLA Assistant bot will prompt you to review and digitally accept this agreement.
Acceptance is tracked automatically against your GitHub username on the cla-signatures branch.
